1. Introduction
    ⁃    Welcome to SHOPIFFA e-commerce solutions Ltd ("SHOPIFFA," "we," "us," or "our"). These Customer Terms of Service ("Terms") govern your access to and use of our services, including our website, mobile applications, and any other platforms we may offer (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

2. Account Registration
    ⁃    Eligibility: You must be at least 18 years old to create an account and use our Services. By registering, you represent that you meet this age requirement.
    ⁃    Account Information: You agree to provide accurate and complete information during registration and to update this information promptly if it changes.
    ⁃    Account Security: You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.

3. Use of Services
    ⁃    Permitted Use: You may use the Services only for lawful purposes and in accordance with these Terms.
    ⁃    Prohibited Conduct: You agree not to:
    ⁃    Use the Services in any way that violates any applicable country, local, or international law.
    ⁃    Engage in fraudulent, deceptive, or misleading activities.
    ⁃    Interfere with or disrupt the operation of the Services.

4. Orders and Payments
    ⁃    Order Placement: By placing an order through the Services, you agree to provide accurate and complete information. You understand that the availability of items and services is subject to change.
    ⁃    Pricing and Fees: Prices and any applicable fees (including delivery fees, service fees, and taxes) will be displayed before you confirm your order. By confirming your order, you agree to the prices and fees presented.
    ⁃    Payment Methods: You must provide valid payment information when placing an order. SHOPIFFA reserves the right to validate your payment method and may place a hold on the payment method for the order amount. Payments shall be made by either your bank debit card or mobile money.

5. Delivery and Pickup
    ⁃    Delivery Services: SHOPIFFA will make reasonable efforts to deliver your order within the estimated time frame provided; however, delivery times are not guaranteed.
    ⁃    Pickup Orders: For pickup orders, you agree to collect your order within the timeframe specified. If you fail to pick up your order within the specified time, SHOPIFFA is not responsible for the condition of the order.
    ⁃    Order Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason.

6. Cancellations and Refunds
    ⁃    Order Cancellations: The order can only be cancelled before it starts processing. Once an order is processing, there is no cancellation. This intends to prevent a lot of financial disputes. You are therefore required to place your order thoughtfully and carefully.
    ⁃    Refund Policy: Refunds may be issued at SHOPIFFA's discretion based on the circumstances, such as if items are missing, incorrect, or damaged upon delivery. Requests for refunds must be made within 1 hour of receiving the order.

7. User Content and Reviews
    ⁃    User Content: You may have the opportunity to post reviews, comments, and other content ("User Content"). By posting User Content, you grant SHOPIFFA a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and modify such content.
    ⁃    Content Guidelines: You agree not to post any User Content that is false, misleading, defamatory, offensive, or that violates any law or third-party rights.

8. Privacy and Data Use
    ⁃    Data Collection: SHOPIFFA collects, uses, and shares your personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms.
    ⁃    Customer Communications: By creating an account, you consent to receive communications from SHOPIFFA, including promotional messages. You may opt out of non-transactional communications at any time.

9. Dispute Resolution and Arbitration
    ⁃    Arbitration Agreement: Any disputes arising out of or relating to these Terms or the use of the Services will be resolved through binding arbitration, rather than in court. You agree to waive any right to a jury trial or to participate in a class action.
    ⁃    Opt-Out: You may opt out of the arbitration agreement by notifying us in writing within 30 days of accepting these Terms.

    ⁃    Changes to Terms: SHOPIFFA reserves the right to modify these Terms at any time. We will provide notice of any significant changes by updating the "Effective Date" above or through other reasonable means. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

11. Termination
    ⁃    Termination by You: You may terminate your account at any time either by yourself or by contacting customer service.
    ⁃    Termination by Us: SHOPIFFA may terminate or suspend your account or access to the Services at any time, without notice, for conduct that violates these Terms or is otherwise harmful to other users or us.

12. Liability and Disclaimers
    ⁃    Limitation of Liability: To the fullest extent permitted by law, SHOPIFFA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenues, arising out of or related to your use of the Services.
    ⁃    Disclaimer of Warranties: The Services are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Governing Law
    ⁃    These Terms are governed by and construed in accordance with the laws of Uganda, without regard to its conflict of law principles.
